To ensure the Rule of Law, protect the citizens right to the freedom of economic activity, protect business and investments, improve the investment climate in the Republic and promote domestic and foreign investments by way of providing a fair and equitable legal regime for the investors and securing all investments made into the economy of the Kyrgyz Republic, based on the Decree of the Provisional Government No.1 as April 7, 2010, the Provisional Government has adopted this Decree No.23 as 26 April, 2010:

1. The Provisional Government of the Kyrgyz Republic guarantees the Rule of Law within the territory of the Kyrgyz Republic.

2. Economic and business activities in the Kyrgyz Republic shall be implemented in accordance with the Constitution and laws of the Kyrgyz Republic and entered into force international agreements and treaties of which the Kyrgyz Republic is the participant.

3. Pursuant to the Kyrgyz Law “On investments in the Kyrgyz Republic”, foreign and domestic investors shall be guaranteed a fair, equitable legal regime, including guarantees for protection of their investments in the economy of the Kyrgyz Republic.

4. Foreign citizens staying in the Kyrgyz Republic on legal grounds shall be guaranteed the freedom of movement within the country.

5. The Provisional Government of the Kyrgyz Republic shall procure the performance of all obligation previously assumed by the Kyrgyz Republic within the framework of international agreements and treaties.

6. The Ministry of Interior Affairs of the Kyrgyz Republic, local state administrations and local self-government agencies shall take all appropriate measures to ensure the implementation of this Decree.

7. Any official and other persons who impeding the attraction of investments, taking measures for illegal seizure of state, municipal, private, public and any other property, including the interference in the business activity and employment issues of companies or organization and employment issue of companies and organizations, or assisting other persons in such action (Raider activity) shall be subject to criminal and civil penalties.

8. The Ministry of Foreign Affairs and the Ministry of Economic Regulation shall be informed the international community and business enterprises of this Decree.

9. This Decree shall come into force upon signing.
